1. Parties

1.2 Members state that these Terms of Use (hereinafter referred to as " Terms ") will come into force upon becoming a member of the Site subject to these Terms and that they are obliged to comply with these Terms.
1.3 Within the scope of these Terms, Sportyps and the members will be referred to individually as "Party" and together as "Parties".

2. Definitions

2.2 Member: You have filled out the membership form on the site and said "I have read and accepted the Terms of Use and Privacy Policy." It refers to the person who has accepted all the terms and conditions in these Terms, approved them and completed the registration process and has accepted the standard terms of use of the site and becomes a free member.

3. Subject of the Terms
The subject of these Terms is to determine the conditions for benefiting from the services offered on the Site and the rights and obligations of the parties accordingly. The scope of these Terms consists of the matters contained in these Terms and all explanations, announcements, Conditions and statements published by Sportyps on the Site regarding use, membership and services. Once published on the Site, they become an integral part of these Terms.

4. Rights and Obligations Regarding Membership Processes
4.1 Sportyps requests people who want to become members of the Site to fill out a form for membership applications. The membership application is evaluated after all information requested by Sportyps is provided completely and accurately and, if an application is made for a paid membership, the necessary fee is paid. As a result of its evaluation, Sportyps may accept the application and allow the applicant to benefit from membership rights, or it has the right to reject the application without giving any reason. If members create more than one member profile with the same or different information and content, Sportyps may immediately cancel all memberships of the relevant member without the need to notify the member, and if the member in question is a Premium or Gold Member, the fee paid by the member will not be refunded.
4.2 In order to become a member of the Site, the person must be a natural person over the age of 13, must not have violated any provision of these Terms before, or his membership on the Site must not have been terminated before due to such a violation or similar reason. At the same time, the person accepts, declares and undertakes that he/she has no obstacle to use Sportyps services and log in to the Site, and that he/she assumes all responsibility regarding the selection and use of Sportyps services and access to the Site. People who do not meet these conditions cannot gain the title of member and membership rights, even if they have completed the membership registration process.
4.3 Sportyps provides the member with access to their personal account and the Site database as a result of their approval, which means accepting these Terms and other warnings and guidance specified on the Site. If the Member accesses the Site through his account on a social media platform enabled by Sportyps, he accepts that he has given Sportyps the necessary authorizations and permissions to access the relevant social media account within the framework of using the Site.
4.4 The created member profile is displayed on the Site after it is approved by Sportyps. However, approval of the fan profile by Sportyps does not constitute a guarantee regarding the accuracy, authenticity and legality of the information contained within the profile.
4.5 The member accepts the accuracy of the personal information contained in his profile. The member determines what information will be included in his profile by playing with his own profile settings.
4. 6 Sportyps reserves the right to close the access of third parties, including members, to the information, content and member profiles uploaded by members to the system, to delete them and to cancel their memberships in cases specified in these Terms. Sportyps may exercise this right without any notice or prioritization. Members must immediately make any changes and/or corrections requested by Sportyps. Changes and/or correction requests requested by Sportyps can be made by Sportyps itself if deemed necessary. Damages, legal and criminal responsibilities that arise or may arise due to the members not fulfilling the changes and/or correction requests requested by Sportyps in a timely manner belong entirely to the members themselves. If a discrepancy is detected in the information and documents submitted to Sportyps or if there is a complaint about him/her, the member may carry out verification processes regarding his/her information by Sportyps in order to ensure the quality of service, and in this context, in addition to requesting additional information and documents from him/her, the Member may accepts that the data can be accessed.
4.7 Sportyps offers some of the services on the Site for a fee and some for free. Sportyps is solely authorized to charge fees in the future for services provided free of charge. The member accepts in advance that he has no right to claim in this context and that current practices cannot be interpreted as an acquired right regarding possible future practices.
4.8 The Member accepts that the scope and pricing status of paid or free services offered through the Site and the scope of Standard Membership and/or Premium or Gold Membership may be changed by Sportyps at any time, with or without notice to the member.

5. Other Rights and Obligations of Members
5.1 The Member is personally responsible for the use and management of all information, including username and password, that allows the use of the Site. The member is obliged to notify Sportyps of any unauthorized use of his/her username and password. Every transaction carried out with the member's username and password will be deemed to have been carried out by the member personally, and the member will be solely responsible for any damages incurred by the member and/or third parties due to the use, loss or change of hands of this information by a person other than the member.
5.2 The member cannot transfer his/her password and member profile to another member under any circumstances or allow it to be used by third parties. If it is determined that the member profile is being used by a person other than the member or if there is a significant suspicion in this regard, Sportyps reserves the right to suspend or terminate the membership.
5.3 The Member undertakes that he/she will not create a membership account in a way that will create fake profiles belonging to someone else or in a misleading or deceptive manner regarding his or her identity, and that the information, content, photographs, pictures and correspondence uploaded by him or her to the Site are accurate and lawful; This information, content, photographs, pictures and other materials will not cause any violation of rights, including the intellectual property rights of third parties, and there will be no campaign and promotional contents, contests, sweepstakes and promotions on the Site belonging to itself, its company or other third parties. will not share offers and announcements or use the Site for other commercial purposes, and will not use passwords etc. for this purpose. He accepts and undertakes that he will not receive any information. In the comments the member added to the posts made by other members; cannot send messages for commercial purposes, cannot advertise in any way, do not express any political views, religion, etc. cannot make propaganda, cannot publish content that encourages racism, bigotry, hatred and physical harm against any individual or group, cannot share immoral sexual content, cannot promise or demand money or monetary values, cannot direct members to another website. The site and Sportyps services are designed for individual use by members and cannot be used by organizations, companies and/or businesses for any commercial or other purpose. Sportyps does not guarantee the security of information transmitted through these means under any circumstances. Information and content uploaded to the Site by the member, especially this article, which are contrary to these Terms and other terms and conditions on the Site, may be removed from the Site by Sportyps without giving any reason, and the member's ability to benefit from the Site may be partially or completely impaired due to such content. may be suspended or terminated.
5.4 All legal, administrative and criminal liability regarding the contents and messages arising from the use of the Site and added to the Site by the member belongs to the member. Sportyps cannot be held directly and/or indirectly responsible for any damages that third parties have suffered or may suffer as a result of the member's activities on the Site and/or actions contrary to these Terms and the law. Any claims from third parties in this context and any damages arising from the member's failure to fulfill its obligations specified in the Terms will be recourse to the member.
5.5 The Member shall comply with the Terms and their annexes and the terms that may be published on the Site from time to time, the law, morality and etiquette, and the principles of honesty in all transactions carried out on the Site and in all content uploaded to the Site, and shall not engage in any behavior that may hinder the operation of the Site by any means. It will not engage in acts that infringe or are at risk of violating the rights of third parties. The Member also undertakes to ensure that the content he/she adds to the Site is free of viruses, spyware, malware, trojan horses, etc. declares that it will not contain harmful materials and that the Site will not be used for purposes such as data mining.

5.7 Sportyps may remove from publication content that violates the intellectual property rights or personal rights of third parties upon notifications sent to it by members or third parties, and also has the right to delete member accounts that repeat such violations and terminate the relevant memberships.
5.8 Sportyps may unilaterally change, add to or renew these Terms, the Privacy Terms as an annex and other terms published on the Site at any time, and reorganize the Site, subject matter, scope and conditions without giving any reason and without any notice. The right to change its content and stop its publication is reserved. Changes made by Sportyps to the Terms, Privacy Policy and other additional documents will come into force on the date they are published on the Site, and by using the Site, the member is deemed to have accepted the updated terms. If the member does not object in writing to the updated conditions within one week following their publication or continues to use the services within this period, it is assumed that the member has accepted the changes. If the me
mber objects to the change, he has the right to cancel his membership immediately, temporarily or indefinitely.
5.9 Regulations regarding the use of member information are regulated under the Privacy Terms, and Sportyps cannot use member information or disclose it to third parties outside the scope specified in these Terms and Privacy Conditions.
5.10 The Member accepts that access to the Site may be temporarily blocked for the implementation of improvements and other changes to be made on the Site.

6. Limitation of Liability
6.1 Sportyps, the member's access to the Site, the Site or the information and other data on the Site, programs, etc. is not responsible for any direct or indirect damage that may arise due to its use. Sportyps does not accept any liability for interruption of the transaction, deletion or loss of data, delay of transaction or communication, computer virus, communication error, theft, destruction or unauthorized entry into records, modification or use of records, except in cases of gross negligence . Sportyps clearly draws the member's attention to the fact that the protection of data in data transfer in open networks such as the Internet cannot be guaranteed comprehensively according to the current technical development and that there may be various risks in data transfer and protection. The member accepts, declares and undertakes that he/she is aware that he/she must take precautions for the security of the information he/she provides on the internet.
6.2 Member, from any content shared on the Site; shall be solely responsible for any damages or violations of rights that may occur due to failure to use the Site and the services offered on the Site in accordance with these Terms and the rules and conditions specified in the relevant sections of the Site, and shall be solely responsible for such content or violation of these Terms or the purposes of use of the Site. Any claims and damages arising from excessive acts will be forwarded or recoursed to the Member. The Member acknowledges that Sportyps has no responsibility to investigate the reality, originality, security and accuracy of any content shared on the Site, including the information and content provided by other members, and to determine whether their sharing is legal or not. or in other media, and that Sportyps is not responsible for the content in question, the violation of the member's rights by third parties, and the damages that may arise due to these.
6.3 Member may provide links to other websites and/or platforms, files or contents that are not under the control of Sportyps through the Site, services of third parties may be offered, and in order to support the website or the person operating/serving such links, or the website or the information it contains. Sportyps accepts and declares that it does not constitute any kind of representation or warranty regarding the site, and that Sportyps has no responsibility for the platforms, websites, files and contents, services or products accessed through such links, or their contents.
6.4 Sportyps will not be liable for any direct, indirect, special, incidental or punitive damages arising from the use of the Site, to the extent permitted by applicable legislation. The Site, the features and other content within the scope of the Site are provided as is, and in this context, Sportyps does not have any responsibility or commitment regarding their accuracy, completeness and reliability. Sportyps makes no warranties, express or implied, regarding fitness for a particular purpose or use or non-infringement under these Terms.
6.5. Access and quality of the Member Site and the contents offered through the Site are largely based on the quality of the service provided by the relevant internet service provider and Sportyps has no responsibility for problems arising from the quality of service in question, the operation of the Site is not free from defects and technical glitches may occur from time to time. He/she accepts and declares that he/she is aware that he/she may encounter access barriers.
6.6 Member acknowledges that Sportyps does not guarantee that there will be no viruses, worms or other attacks or unauthorized access to the Site or that information will not be transferred from or to the Site, and that Sportyps does not provide support, maintenance, updates or new versions regarding the software. He acknowledges that he knows that he has no obligation to provide it.

7. Force Majeure
7.1 In all cases deemed as force majeure, the Parties cannot be held responsible for late or incomplete performance or non-performance of any of their acts specified in these Terms. Force majeure; It will be interpreted as events that occur beyond the reasonable control of the relevant party, including but not limited to natural disasters, riots, war, strikes, lockouts, malfunctions caused by telecommunications infrastructure, power outages and bad weather conditions. During the force majeure period, the Parties' actions are suspended. If the force majeure continues for more than 1 (one) month, these Terms may be terminated by the Party whose rights cannot be fulfilled.
8 . Force
8.1 These Terms and Conditions, which are an integral part of the Privacy Terms and all Terms notified on the Site, come into force when the Member reads and accepts the Terms.

9 . Suspension and Termination of Terms
9.1 Except for the cases expressly stated in these Terms, the member's failure to comply with the regulations contained in the Terms and the rules and conditions declared on the Site, his/her use of the Site for any commercial purpose, any violation of the member's activities or any information he/she has included on the Site, if any. If the content poses a risk in terms of legal, technical and especially information security or is harmful to the personal and commercial rights of third parties, Sportyps may temporarily or permanently suspend the member's use of the Site. If the violation in question is not remedied in response to the notification made by Sportyps, these Terms may be terminated by Sportyps. For this reason, the member cannot have any requests from Sportyps.
9.2 In addition to the cases specified in these Terms, if the member sends messages, messages or similar communication elements during the day that are contrary to the principles and purposes of use of Sportyps, Sportyps will take action, at its sole discretion, regarding the quality and quantity of the contrary communication element in question. As a result of the evaluation, Sportyps may block your current membership without stating any reason. Sportyps has the sole discretion as to whether the number of messages, messages or similar communication elements sent during the day is contrary to Sportyps' principles and purposes of use. If Sportyps blocks the member's current membership on the grounds that the number of messages, messages or similar communication elements sent is contrary to the principles and purposes of use of Sportyps, it makes warning and informative notifications to the member. If the member exceeds the final limit on the number of contrary communication elements determined by Sportyps, does not take into account the warning and informative notifications made by Sportyps and does not fulfill the requirements, the member's current membership will be terminated completely. The member accepts, declares and undertakes in advance that he has read and understood the provision set out in this article and that he is within his knowledge of this provision.
9.3 Sportyps may suspend or terminate the Site and/or these Terms at any time, temporarily or indefinitely.
9.4 The Member can cancel his standard membership from the membership settings section of the Site. After the membership is cancelled, some records regarding the membership, such as age, gender, photo and city information, are kept in the site's database for thirty (30) days. By signing these Terms, the Member consents in advance that this information will continue to be published on the Site and used by Sportyps in the ways specified in these Terms and their annexes for thirty (30) days from the date of cancellation. At the end of this period, all records regarding the canceled Membership will be deleted from the database.
9.5 The member is obliged to specify his e-mail address and user code / security password information in the termination notification regarding his membership for identity verification.
9.6 If the member's Site membership terminates, the contents, photographs and information shared on his or her profile uploaded to the Site will be deleted from Sportyps records as stated above, and the member accepts that he/she will no longer have access to this information if he/she re-establishes membership for any reason.
9.7 Even though the Member's membership under these Terms has terminated, the obligations that the Member has undertaken to fulfill and the obligations arising from the protection of personal rights and confidentiality remain the same. By canceling his/her membership, the member cannot take back the payments he/she has made as he/she will waive the unused portion of the paid services.

10. Recourse and Waiver
10.1 No waiver of any right or remedy set out in these Terms will be effective unless in writing. A waiver is effective only in the circumstances in which it was given, and no waiver of any term, term or condition of these Terms shall be deemed or construed as a further or continuing waiver of the same term, term or condition.

11. Dispute Resolution
11.1 In all disputes that may arise regarding these Terms, the provisions contained in this text will primarily apply, and in cases where there is no provision, the Laws of the Republic of Turkey will apply. Izmir Courts and Enforcement Offices will be authorized to resolve disputes arising from the application of the Terms.

12. Information and Announcements
12.1 Announcements made to members from Sportyps are made after logging in from the sections on the screen or via e-mail. Members' notifications to Sportyps must be made via e-mail to support@sportyps.tv unless additional methods are specified in these Terms.
